The parties specifically agree to the following terms and conditions upon instructing Master Legal Cost Consultants:
Fees for drawing a Bill of Cost:
• 11% of the fees drafted (not taxed) upon signature of the Certificate in terms of Rule 70 of the Uniform Rules of Court.
Fees for attending Taxation:
• 11% of the first R10 000-00.
• 6% of the second R10 000-00.
• 3% of the balance.
Fees for opposing a Bill of Cost:
• 10% of what was taxed off from the Bill of Cost.
General Terms & Conditions:
• All fees are due and payable on the due date as stipulated on the invoice.
• Fees for drawing a Bill of costs are within 30 (thirty) calendar days from the date of the invoice.
• Fees for attending taxation or opposing taxation on behalf of a client, will be due and payable within 7 (seven) days from the date of the invoice.
• Any outstanding amounts of this 30 (thirty) day period will attract interest at the current rate of legal interest per month.
• Should no objection be received within 7 (seven) days after receipt of the invoice, the client will accept the amount due as per the invoice.
• The parties agree when instructing Master Legal Cost Consultants, that the client will be the respective attorney or firm giving the instruction, and not the party being represented on behalf of the respective attorney or firm.
• The client agrees when instructing Master Legal Cost Consultants, that the client, i.e., the instructing attorney and / or firm will be liable for any monies due and payable to Master Legal Cost Consultants.
• The parties specifically agree to the jurisdiction of the Magistrates’ Court irrespective of the amounts owing, and furthermore, agree that the whole cause of action shall be deemed to have arisen in the Magisterial District of Mogale City, formerly known as Krugersdorp, this being the place where the instruction is acknowledged and the work performed.
• The client agrees that the client will be held liable for costs attorney-and-own client scale, inclusive of any fees and disbursements incurred in respect of counsel for consulting, preparation and attendance fees.
• The terms and conditions herein stated shall not be altered or varied under any circumstances, unless made in writing and confirmed by Master Legal Cost Consultants.
